MB/LAW is pleased to announce the successful completion of arrangement approval proceedings for an entrepreneur in the insurance-credit sector, specialising in credit intermediation, insurance intermediation, and HR services.
The entrepreneur had been conducting business since 2021 as an insurance agent and credit broker, with registered office in Legionowo. The business involved providing credit and insurance brokerage services to private individuals, sole proprietors, and commercial companies. Since 2024, the entrepreneur additionally began providing HR services to another business, primarily employee recruitment.
Due to cooperation with a new business partner (the cooperation did not generate the expected results and the revenues were disproportionately low compared to the significant time investment), the establishment of a new cooperation with a well-known insurer in September 2023 (substantial time commitment required for training and examinations, with relatively low income after completing onboarding), attempts to diversify income sources (no expected financial results despite significant workload), and deterioration of mental health (psychiatric treatment started in 2023; poor mental condition significantly hindering business activity), the entrepreneur fell into financial distress beginning in July 2023.
Thanks to the work of the arrangement supervisor – attorney-at-law Michał Burek, LL.M., qualified restructuring advisor, licence no. 1665 – and the support team, it was possible to reach an agreement with creditors, conduct voting, and adopt the arrangement. This was confirmed by a decision of the District Court for the Capital City of Warsaw dated 16 July 2025.
- bank creditors with claims ≥ PLN 35,000 (Group 1) – remission of interest and ancillary costs; repayment of 100% of principal in 86 equal monthly instalments with a 2-month grace period,
- leasing creditor (Group 2) – full remission of interest, court fees, enforcement costs and other ancillary claims; repayment of 70% of principal in 72 equal monthly instalments with a 2-month grace period,
- Social Insurance Institution (Group 3) – full repayment of the claim (principal and interest accrued up to the arrangement date and from the arrangement date until each instalment’s payment date) in 84 equal monthly instalments with a 2-month grace period,
- Tax Office (Group 4) – full remission of interest and ancillary claims; repayment of 60% of principal in 24 equal monthly instalments with a 2-month grace period,
- private-law creditors with claims > PLN 10,000 (Group 5) – full remission of interest, court fees, enforcement costs and other ancillary claims; repayment of 60% of principal in 72 equal monthly instalments with a 2-month grace period,
- private-law creditors with claims ≤ PLN 10,000 (Group 6) – full remission of interest, court fees, enforcement costs and other ancillary claims; repayment of 60% of principal in 24 equal monthly instalments with a 3-month grace period,
- the arrangement was adopted under Article 119(3) of the Restructuring Law – 91.29% of the voting claim value voted in favour,
- continuation of business activity in the specialist financial intermediation sector was ensured.
