MB/LAW Law Office is pleased to announce the successful completion of restructuring proceedings for an entrepreneur based in Łódź, operating in the design and production implementation sector, including specialist CAD design, project execution and production management.
The entrepreneur has operated since 2006, focusing on delivering designs from concept to production stage. The company also provides end-to-end production management services through a network of domestic and international subcontractors. In recent years, a core business area was the manufacturing of greenhouse reflectors.
Financial difficulties began following the loss of the company’s main customer – a Dutch exporter delivering to the Russian market. Due to sanctions and the market closure, revenues dropped significantly. The situation was further worsened by increased interest rates and rising social security contributions (ZUS), which raised monthly loan burdens.
Following a detailed analysis by the MB/LAW team, led by attorney-at-law Michał Burek, LL.M., licensed restructuring advisor (lic. no. 1665), it was decided to initiate a restructuring approval procedure (PZU). A precise restructuring plan and timeline were developed.
- the creditors accepted the restructuring proposal and the arrangement was adopted,
- the arrangement was formally approved by the District Court in Łódź on 3 January 2024 (Case No.: LD1M/GRz/52/2023),
- all interest on unsecured claims in creditor groups 3 and 4 was fully written off,
- a realistic instalment plan was agreed upon, reducing the entrepreneur’s monthly liabilities by several dozen percent.
Importantly, the arrangement was approved despite partial lack of majority in certain creditor groups, by meeting the requirements of Article 119(3) of the Restructuring Law. The plan ensures significantly better creditor satisfactionthan would have been possible in insolvency proceedings.
