MB/LAW Law Office is pleased to announce the successful completion of a restructuring approval procedure for a business operating in the medical-consulting and aesthetic medicine sector.
The entrepreneur provides medical services, consulting, and aesthetic treatments. Financial problems began during the COVID-19 pandemic, when the practice was temporarily suspended. The situation worsened due to the rising costs of medical equipment, energy, staff shortages, and increased competition. Significant tax burdens introduced under the “Polski Ład” (Polish Deal) also contributed to the liquidity crisis.
After reviewing the financial documents and holding in-depth consultations, the MB/LAW team, under the leadership of attorney-at-law Michał Burek, LL.M., a licensed restructuring advisor (no. 1665), recommended initiating a restructuring approval procedure (PZU). Precise restructuring proposals and an implementation schedule were prepared.
Thanks to the efforts of the restructuring supervisor and the MB/LAW team, the plan was adopted by creditors and formally confirmed by the court on 25 January 2024.
- The secured creditor (Group 1) was included in the plan – repayments follow the original credit agreement schedule,
- Interest and incidental costs were fully waived for selected creditor groups,
- Debt repayments were spread over 36 to 96 months, depending on the group,
- Tax liabilities (toward the Tax Office) were spread over 36 instalments with no further interest,
- All key creditors, including secured ones, were successfully covered under the plan,
- The monthly instalment was reduced by over ten thousand zlotys.
Although the plan was not accepted by all creditor groups, the court approved it under Article 119(3) of the Restructuring Law. The court determined that the objecting creditors would be satisfied to a level no less favourable than in bankruptcy proceedings.
